The FDCPA prevents harassment, and the simple statement "Please talk to my attorney" is often enough to make many of them stop.

There are three ways we can stop creditor harassment:

  • Prior to filing for bankruptcy, the FDCPA rules apply.
  • Once a bankruptcy has been filed, the automatic stay stops all collections, most civil lawsuits, and most other creditors attempts to obtain your property - unless the creditor first obtains a Bankruptcy Court order that authorizes the creditor to do so.
  • After your debts have been discharged by Bankruptcy Court order, a permanent injunction automatically prohibits your pre-bankruptcy filing creditors to collect the discharged debts.
