Utah Vehicle Repossession Lawyer

If you have overwhelming debt, and you're being subjected to creditor harassment and threats of repossession, an experienced bankruptcy attorney may be able to help you hang on to the possessions that are most important to you.

There are some possessions which are exempt during bankruptcy according to federal law, and Utah has its own list of exemptions.

"Don't voluntarily give up your car or truck without talking to us. You may not be able to get another one so we should work to keep the vehicle you currently have." — Attorney Paul Toscano

Understanding Exemptions and Repossession

There are some items of property that are exempt from repossession during bankruptcy. We will work with you to determine whether a Chapter 7 or Chapter 13 bankruptcy is better for you, based on your assets, liabilities and projected income.

The details are somewhat complicated, but in general the following items are exempt in Utah for each person filing:

  • Utah homestead exemption — up to $20,000 of equity in a primary residence
  • Auto or truck — up to $2,500
  • Animals, books and musical instruments — up to $500
  • Household goods and clothing — up to $500
  • 12 months of provisions
  • Health aids (medication)
  • Heirlooms — up to $500
  • Furniture and appliances — up to $500
  • Wages — 75 percent of disposable weekly earnings is exempt from ordinary creditors

At The Law Office of Paul Toscano, PC, we have more than thirty years of bankruptcy experience and are well aware of what you are allowed to keep, what you may be able to keep and what you probably won't be able to keep.

Our financial discussion with you starts with our initial meeting, and then we determine the best course of action for you based on your circumstances and your goals.
